The website www.e-gsamaras.gr is an e-commerce store trading products via the Internet (hereinafter referred to as "online store" or "website" or "site") created and operated by the company named "G.SAMARAS S.A.-MEDICAL GAS SYSTEMS", seated in Industrial Area of Thermi, P.O. Box 60178, 57001, Thessaloniki, and is legally represented, e-mail address: eshop@gsamaras.gr, telephone number for e-shop customer service: +30.2310.463388, (hereinafter referred to as "the Company"). The following terms and conditions will apply to the use of the e-shop under the trademark "G.SAMARAS S.A.". The General Terms and Conditions of Sale of "G.SAMARAS S.A." are posted on the Company's website at https://www.gsamaras.gr/en/terms-of-sale.

Any user who visits and trades with the online store (hereinafter referred to as "visitor" or "user" or "customer" depending on whether it is limited to a visit only to the store or also orders and purchases products) is hereby deemed to consent and accept unconditionally the following terms herewith without exception. If a user does not agree with these terms, he/she should refrain from the visit, use of the site as well as any transaction or use of the e-shop services. However, any action by the user in the online store, including, but not limited to, browsing, subscribing to the newsletter of the Company, or buying products is considered as an unconditional acceptance of these Terms of Use.

1. TERMS

G.SAMARAS S.A. reserves the right to unilaterally modify or renew the present terms and conditions of transactions made through its online store. G.SAMARAS S.A. undertakes to inform users about any modifications and any changes, through the website of this e-shop. It should be noted that any modifications or changes to the relevant terms of use do not affect and do not apply to orders which have already been placed.

2. INFORMATION PROVIDED AND PRODUCTS

G.SAMARAS S.A. is committed to the completeness and validity of the information on the website of www.e-gsamaras.gr, both as regards the existence of the essential characteristics described for all products available, as well as the accuracy of their data, subject to any technical or typographical errors that have escaped our attention or have occurred inadvertently or due to any downtime of the website on the grounds of force majeure.

3. LIMITATION OF LIABILITY

G.SAMARAS S.A. guarantees timely information to end consumers about the unavailability of the products. G.SAMARAS S.A. e-shop is not responsible for any technical problems that may occur to users when attempting to access the Website and during their time on site that are related to the performance or compatibility of their own infrastructure with the website. In addition, G.SAMARAS S.A. also bears no responsibility for the acts or omissions of third parties and in particular unauthorized third parties' interference with products and/or services and/or information available through its e-shop. Wherever the current website contains links to third party websites, G.SAMARAS S.A. is not responsible for the contents of those websites, or any harm caused to the user by those sites, since the users have access to those websites exclusively at their own choice and responsibility.

4. INTELLECTUAL PROPERTY RIGHTS

4.1. The website www.e-gsamaras.gr is the official e-shop of the company G.SAMARAS S.A.. All of the website’s contents (e.g. software, information, data, trademarks, logos, photographs, graphics, designs and any other distinguishing characteristics of all digital files in general) constitute the Company’s copyright and are protected by Greek, EU and international laws regarding intellectual and industrial property.

4.2. Potential reproduction, publication, upload, declaration, transmission or distribution or any other use of the content, in any manner or through any means, for commercial or other purposes, is allowed exclusively upon written consent of G.SAMARAS S.A. or any other potential copyright owner. Exceptionally, it is permitted to individually store a single copy or portion of selected content (from the digital content of the website) on a personal computer solely for personal use and not for public or commercial use and always without deleting data that indicate its origin from this website.

4.3. The names, pictures, logos and distinctive characteristics that represent www.e-gsamaras.gr or third parties and their products or services are exclusive to www.e-gsamaras.gr and the third parties, and are protected by the relevant laws regarding intellectual and industrial property trademarks. Their appearance on the website cannot under any way be interpreted as transmission or permission to use them. Hence, the Company is not liable for the unfair use of third-party trademarks by others.

5. PERSONAL DATA PROTECTION

5.1. During your visit to the pages of www.e-gsamaras.gr you may be asked to provide your personal information (name, business name, email address, product shipping address, etc.) in order to process your orders. Any personal data you provide anywhere on the pages of www.e-gsamaras.gr are kept solely for reasons relating to your transactions with us as well as the improvement of the services provided and not may be used by any third party (except as otherwise provided by law). 6. USER’S OBLIGATIONS

6.1. The users of the e-shop www.e-gsamaras.gr accept and commit to not use the Company’s e-shop to send, transmit, publish or in any other way transmit illegal, damaging, menacing, racist, insulting, annoying, libelous, slandering, vulgar, immodest, or harmful to minors contents. The user is obliged to use the website in accordance with the law, principles of good conduct and the current terms, and to not proceed to actions or omissions which may result to the website’s damage or underperformance, or which may place www.e-gsamaras.gr‘s operation in jeopardy.

6.2. Users are not allowed to transmit inside or confidential information which was obtained or revealed through transactions, or which is covered by confidentiality agreements, or information which violates any patent, trademark, intellectual property or other third party property. Finally, users are not allowed to intrude and install software viruses or any other kinds of code, files or programs which have been designed with the aim to terminate, cause damage, destroy or disrupt the operation of any computer software or hardware, on purpose or unwittingly, because any such action violates relevant legislation. In addition, users are not allowed, while visiting the company’s website, to abuse third parties in any manner, or to use the website in order to collect or save users’ personal data.

SAMARAS S.A. recognizes the importance of secure transactions as well as your Personal Data and has made all necessary provisions, using the most modern and advanced methods to ensure maximum possible transaction security for all data entered in the website. All information related to your personal information and transactions is secure and confidential. This is achieved by the following methods:

9. PRODUCT DELIVERY POLICY

9.1. Shipping costs are not included in the product price, and are borne by the buyers, unless it is explicitly stated otherwise. Delivery time is set on a case by case basis.

9.2. By placing products in your order basket, you can see your order’s shipping cost. The shipping cost is not standard, but varies depending on your location, as well as the size and weight of your order.

9.3. In case the product is not immediately available for shipment, the order will remain pending and our company will keep you informed about the expected availability date, the substitution or cancellation of the order.

9.4. The address specified by the buyer must be real and valid. In case the buyer is absent from the address he/she has specified, or his/her address details have changed, the buyer is responsible for notifying the company in a timely manner, in order to organize the shipment to the correct address. Otherwise, the buyer will bear the additional shipping cost.

9.5. In contracts where the supplier sends the products to the consumer, the risk of loss or damage to the goods is transferred to the consumer when he or a third party who is defined by the consumer and is different from the carrier has acquired the physical possession of the goods. However, the risk is transferred to the consumer upon delivery of the goods to the carrier, subject to the consumer's rights to the carrier, if the carrier has been instructed by the consumer to transport the goods and that option was not offered by the supplier.

10. RIGHT OF WITHDRAWAL/RETURN POLICY

10.1. According to distance selling regulations (eg via the Internet), you may return a product and ask for a refund by notifying us in writing via the contact form https://www.e-gsamaras.gr/return-products-form or by calling Customer Service at +30.2310.463388 or fax it to +30.2314.410113 within 20 calendar days of the date of receipt of the product. If you order a batch of products, the deadline starts to run when you receive the last product in the batch. Finally, in the event of purchase of digital content that is not stored on a fixed basis, the deadline starts to run on the date of conclusion of the contract. By requesting withdrawal, you are obliged to return the product to us in its original state (as new) in which it was delivered to you or to provide us with clear evidence that you have shipped it safely within 20 calendar days. Within the same deadline we are obligated to refund any amounts you have paid us using the payment method you have chosen. In the event that you have paid with a credit card, we will immediately issue an order to the issuer of the card. However, we are not responsible for any delays in your refund that are not due to us.

10.2. We shall not be liable and will not indemnify the buyer in case we determine that any claimed defects in the products were caused by misuse, abuse, vandalism, neglect, improper handling, installation or shipment, unauthorized repair, purchase from an unauthorized source, alteration or accident or damage due to the elements or similar causes not within the control of Seller or its authorized supplier.

10.3. In any case, to be eligible for a return, the Products should be in the same condition as delivered, sealed and intact in their original packaging, along with the original purchase invoice. It is clarified that the shipping costs for returning the product are not covered by G. SAMARAS S.A. and are incurred by the buyer.

10.4. Indicatively, the right of withdrawal shall not apply in the following cases:

1. if the service is provided in full within 20 days. The right to cancel can be lost during the cancellation period if the service is provided in full before the 20 days elapses.
2. products that the entrepreneur has established in accordance with the consumer’s specifications
3. products that after delivery, because of their nature, are inextricably intertwined with other elements
4. contracts according to which the consumer has specifically requested a visit from the supplier with a view to carrying out emergency repairs or performing maintenance work. If, in the event of such visit, the supplier provides services in addition to those specifically requested by the consumer or goods in addition to the spare parts compulsorily used during maintenance or repairs, the right of withdrawal shall apply to such additional services or goods.
5. In the case of purchases of devices including software that is activated after a trial period of which the consumer is aware and within which the consumer must either withdraw or accept the product and software, the withdrawal shall not apply if that trial activation time has elapsed without the relevant right having been exercised.
6. WARRANTY AND SELLER’S LIABILITY

11.1. G. SAMARAS S.A. is obliged to deliver to the consumer the goods with the agreed properties and without any real defects. The warranty provided is valid for two years from the date of invoice issue. In the case of sale of second-hand goods, the seller and the consumer may agree to a shorter period of time for the limitation of seller's liability other than that provided in relevant legislation. In any case, this period may not be less than one (1) year. The consumer's relinquishment of his protection prior to the appearance of a defect or lack of a contractual property is void.

11.2. All durable consumer goods shall be accompanied by the written guarantee of the manufacturer of the product or of the company which imported the product into the EU or of the company which affixes the product its trade mark (hereinafter referred to as "the Supplier"). Please pay close attention to the terms and conditions of the warranty provided by the Supplier as well as to the other accompanying documents and information that are under the responsibility of the Supplier that are included in the products and in particular to those relating to information on the safe use and maintenance of the products.

11.3. G.SAMARAS S.A. shall provide the consumer with clear and complete instructions for the use, maintenance and full utilization of the product. These instructions must be provided in Greek or in English with internationally established symbols, in writing or on a fixed imprint available and accessible to the consumer. Products which are simple in their manufacture, use and maintenance, are excluded from the previous obligation, as long as the manufacturer does not provide instructions in any language.

11.4. G.SAMARAS S.A., as Supplier of new durable consumer goods, may ensure, upon written agreement in which the corresponding price is set, that consumers continue to receive technical services for maintenance and repair of their products as well as quick and reliable supply of spare parts and other goods required for their intended use, for a defined period of time.

11.5. Finally, G. SAMARAS S.A. has all the obligations set forth in relevant legislation for the seller. Especially in case of defect of the product sold you can: a. request to have the product repaired at your own expense or ask for replacement, unless this is impossible or it requires disproportionate costs, b. ask for a price reduction, c. pull out of sale, unless the product has insignificant defects. The above obligations do not apply if the defect is caused by the buyer or by force majeure. In all cases, the products must be accompanied by the original purchase invoice and relevant receipts.

12. DISPUTE RESOLUTION

SAMARAS S.A. pays special attention to serving consumers’ needs and solving any problems they may have with their transactions with the Company. However, in the event that we are unable to fully resolve any issues you may have and you believe that to any extent any of your rights in any of our transactions are infringed, the parties agree to the exclusive jurisdiction of the courts of Thessaloniki, Greece, for any dispute arising out of or in connection with this contract. These General Terms of Use shall be governed by and construed in accordance with the law of Greece.
